Legal requirements
State is significantly behind on HAVA compliance and will not be compliant by 2006 elections. DOJ filed suit in March to move things along and an interim arrangement, informally called 'Plan B,' is planned for the November 2006 election (download PDF ). State law requires voter-verifiable paper records and manual audits in randomly selected precincts. New York is one of just two states banning all wireless capability in e-voting machines.

Also behind schedule. Interim database, NYSVOTER1, has launched; state will work with Saber Corp. on final version, which will be based on Wash. State version (download PDF ).

State legislation requires a voter-verifiable paper record, but there is no requirement that precincts be randomly selected for manual auditing. Vermont is one of six states using new vote-by-phone technology this year -- and almost certainly the first in the nation to inaugurate drive-through voting.
