Oracle, Google patent trial postponed
The judge canceled the Oct. 31 start of the jury trial and has yet to set a new trial date
IDG News Service - The patent and copyright dispute between Oracle and Google won't go to trial on Oct. 31 as initially scheduled, according to the judge overseeing the case.
On Wednesday, Judge William Alsup issued an order canceling the Oct. 31 jury-trial start date as well as a pretrial conference set for Oct. 24. "Dates for the final pretrial conference and trial will be re-set in due course," he wrote.
The cancellation is the result of a scheduling conflict at the court due to a large criminal trial that started earlier this week.
Alsup warned earlier this month that the trial would probably be postponed, but at the time he was reluctant to cancel the date.
The companies appear to have been busy preparing for the trial to start. On Tuesday, they filed a lengthy list of exhibits to be presented during the trial.
Oracle filed the suit last year, charging Google with infringing on patents and copyrights in Dalvik, the virtual machine that runs Java applications in Android. Oracle acquired Java patents along with its purchase of Sun early last year. Google denies wrongdoing.
