Apple v Samsung post-turkey patent escalation: MADness?

Apple (NASDAQ:AAPL) and Samsung each added more of the others' products to their existing patent litigation over the last few days. With no resolution in sight before 2014, this one could run and run. It would seem that mutually-assured destruction is imminent. Or, y'know, they could just settle, right?

John Ribeiro reports:

The South Korean company said...that the products were released by Apple after Samsung submitted its original infringement contentions. ... The products included in the latest motion...are the iPad mini and the latest versions of the iPad and iPod touch.

...

The proof of infringement...by the three new products will be substantially the same as for other Apple devices already accused...Samsung said. ... The move by Samsung follows an order by the court [that] allowed Samsung to include the iPhone 5.  MORE

John McCrank notes the continuing tit-for-tat:

Apple Inc has asked...to add six more products to its patent infringement lawsuit...including the Samsung Galaxy Note II...Galaxy S III...Galaxy Tab 8.9 Wifi...Galaxy Tab 2 10.1...Rugby Pro, and the Samsung Galaxy S III Mini.

...

Apple filed the second lawsuit in February, alleging that [they] infringed eight of its patents. Samsung denied infringement and filed a cross-complaint alleging that Apple...infringed eight of its patents.  MORE

This is madness? No, this is John Paczkowski:

The escalation...continues apace, its breadth seemingly limited only by the current size of the pair’s product lines.

...

Thing is, this case isn’t scheduled to go to trial till March 2014. ... So expect another update or two to the case’s infringement contentions before it actually goes to trial. ...with each one, the revenue base against which the companies are claiming damages increases.  MORE

And Richard Goodwin notes Samsung's phablet sales success:

Samsung has shipped five million units of its Galaxy Note 2...a massive increase from figures released at the beginning of November. ... The company has confirmed that the device is selling exceptionally well in all regions.

...

shifting five million units of a device that many labelled as stupidly big is testament to Samsung’s knack for developing products that it knows customers’ want. ...expect to see lots more innovation from Apple’s arch-nemesis during the coming year.  MORE

Meanwhile, John Davidson would like to thank Apple for motivating Samsung:

Samsung executives decided the best way to beat Apple was to make devices with humungous screens. ... Hence the original 5.3-inch Galaxy Note [and] now, the Note II, a phone with a humungous 5.5-inch screen...much bigger than the iPhone’s 4-inch screen. ... It’s terrific.  MORE
